NJ MVC Suspension Reduced to Zero Days at ‘Operating During a Suspension Period’ Hearing

We’re happy to blog on a big win for us yesterday, as our client walked out of a Trenton NJ MVC Hearing with his license intact, and no suspension to follow.

The MVC Hearing was for an “Operating During a Suspension Period” suspension, where the individual received a cell phone ticket (but no Driving While Suspended ticket) during a period where his license was suspended. The NJ MVC issued a proposed suspension of 180 days, which we responded to with a written hearing request on behalf of the client. This written request presented material facts at issue relating to the constitutionality of the proposed suspension, and was mailed prior to the scheduled suspension date in accordance with the instructions of the Scheduled Suspension Notice.

After the request was accepted, a hearing date was scheduled, and the driver’s license was not suspended until the hearing could take place, and a final decision made on the term of the suspension. At the hearing, we presented arguments to the representative. These arguments were clearly well-formed, as the representative made an offer to take no action on the driver’s license.* That is a complete termination of the proposed suspension!

The client couldn’t have been happier, as he could continue driving and would see no interruption in his ability to operate his business and caring for his family.

Many times, these suspensions are simply reduced. It is common (though not guaranteed) for a proposed NJ MVC Operating During a Suspension Period suspension to be reduced to 90 days, 30 days, or even 14 days, depending on the circumstances and facts involved in the case. This particular case was a perfect result that we’re proud have been able to achieve for our client.
