Two Operating During Period of Suspension Violations and Two Separate Point Violation Suspensions Reduced by Nearly 97%

We were recently retained by an individual who was facing an 18 month (570 days) suspension based on a variety of driving violations. This client had actually never even obtained a permit or license, but had been driving and subsequently suspended on and off for the last five (5) years. The Motor Vehicle Commission had our client on their radar and wanted to keep him on the hook for the entirety of this proposed suspension that stemmed from two (2) incidents of Operating While Suspended and two (2) different time where he received points for a moving violation that put him in excess of 12 (he was currently at 18 points on his license). Unfortunately, our client had already missed the required time period for which to request a formal hearing. Nevertheless, I was able to file a petition to grant and exception for my client, whereby he would still be granted a hearing, even though his required request date had long passed. We were eventually granted a hearing date and we put together our case to present to the Hearing Officer for each of the four separate violations.

At the hearing, I was able to work our a plea suspension agreement that dismissed three of the violations (two persistent violators suspensions and one of the operating during a period of suspension violations) and had the fourth violation reduced from 180 days down to just twenty (20)! Additionally, by having one of the Operating While Suspended Violations dismissed, I was able to save my client $750 in surcharges.  The fact that my client was able to have his license eligible for restoration before December was phenomenal news since he was looking a suspension that would run him until 2017.
